2. Setting up your own business and apply for the Malaysia 2-years DP10 work permit under your own Malaysia Sdn Bhd company comes in two forms:
a. A non-resident company where foreigners can own 100% Malaysian Private Limited (Sdn Bhd) Company
This category is meant for foreigners who wish to run his own business in Malaysia. Please ensure your intend businesses are permissible in Malaysia before you incorporate your company! We can assist you to check out the types of businesses and industries are not allowed. This will ensure you, as a foreigner able to successfully obtain your 2-years Malaysia Work Permit (DP10), without any hitches.
To apply for Shareholders/Directors key position for DP10 Work Permit, you are required to have a minimum of RM500,000 share. As such, your company is required to set-up with a minimum authorized capital of RM1 million. For non-resident companies, you do require the trade license such as Whole, Retail Trade License (WRT). The license application will take about 2 to 3 months for approval. Bear in mind, WRT license is only applicable to “unique” business nature and “benefiting to Malaysia’s economy” will be approved.
The processing time from incorporating the company, setting up the office, trade license and 2-years (DP10) work permit application until final visa endorsement onto your passport is about 6 to 9 months. The time may be longer as you need also to set-up your office/shop as well as the bank in your capital into your bank account for filling your paid-up capital to be RM1 million.
b. Joint-Venture with Local Malaysian for the Malaysian Private Limited (Sdn Bhd) Company
You can also form a company joint venture with local Malaysian, the paid capital required under Immigration regulations to allow such company eligible to apply for a work permit for foreigners is RM350,000. Under this company structure, your company does not require WRT license if your local Malaysian partner owned more than 50% shares. Depends on the nature of business and profile, Immigration authority may approve your DP10 2-years work permit for the newly formed company.
The approval is very stringent for the new company as there are no activities. However, if the new company able to present recommendation letters from other Governmental bodies, the Immigration may consider approving your DP10 work permit application is higher.
The time frame processing from setting up the company, apply for the work permit until final endorsement of visa onto your passport: 2 to 3 months.
3. Be employed by Malaysian Companies or Regional/Representative Office in Malaysia and get a work permit for 2 years
Under this category, the business owners and employers can apply the Malaysia DP10 work permit (2-years visa) for the foreigners whom they wanted to hire. The foreigner will take on a normal employment contract with the company, and the salary has to be minimum RM5,000 in order to qualify under Immigration’s guidance.
The positions can be hired by the companies has to meet the approval of the Immigration Department of special skills and education as follows:
Specialist/Technical/Skill Position- you are required a minimum Bachelor Degree qualification related to the required positions. For this category, please ensure the positions are permissible for foreigners by the Immigration Department of Malaysia to successfully issue a Malaysia work permit for you and family.
Once you have decided on the hiring of your expatriate working with you, feel free to contact us to find if your company’s requirement is met. The processing approval by the Immigration Department usually takes about 1 to 2 months from application stage to final endorsement of visa. For a new company less than 1 year in operation and without substantial turnover/transactions, the hiring usually will be rejected by the Immigration Department.

4. Setting up your own Regional/Representative Office in Malaysia and get a work permit for 2 to 5 years
If you have a company in your own country and have been established at least 2 years, you may set-up a Regional/Representative Office in Malaysia. The Regional/Representative Office is not allowed to do any commercial transactions (sales) with Malaysian companies. It serves as coordinating center, fact-finding, survey and opportunities sourcing only.
Through this path, you and your family can apply for 2 to 5 years work permit depends on the length of your regional/Representative Approval. Processing time for approval until final visa endorsement on your passport takes about 2 to 3 months.
